Terms and Conditions – NFT Transfer

1. General Overview

These Terms and Conditions (“Terms”) govern the sale and transfer of the non-fungible token (“NFT”) associated with this listing (“Item”). By purchasing this NFT through eBay, you (“Buyer”) agree to abide by these Terms as set by the Seller. Please review all Terms carefully before completing your purchase. Purchasing this NFT constitutes acceptance of these Terms in full.

2. Purchase and Payment

  • The sale of the NFT will be considered complete only when payment has been received and verified in full via eBay’s official payment system.

  • The Seller will not initiate any NFT transfer or blockchain transaction until payment has cleared successfully.

  • Any delays in payment processing or clearance by eBay or related payment providers may delay the NFT transfer.

  • The Buyer acknowledges and accepts that the Seller is not responsible for any delays caused by eBay’s payment verification systems or third-party payment processors.

3. Feedback Requirement Before NFT Transfer

  • In addition to payment completion, the Buyer agrees to submit feedback for the transaction through eBay’s feedback system.

  • Feedback serves as confirmation that the Buyer has received and reviewed the transaction details in eBay’s system and is satisfied with the purchase process.

  • The Seller will begin the NFT transfer only after both of the following have been verified:

    1. Payment has been fully processed and cleared.

    2. Feedback has been submitted by the Buyer on eBay.

  • Failure to provide feedback may result in a delay or suspension of the NFT transfer.

4. NFT Delivery and Wallet Address

  • The Buyer must provide a valid digital wallet address that supports the blockchain network on which the NFT exists (e.g., Ethereum, Polygon, etc.).

  • The Seller will not be held responsible for:

    • Sending the NFT to an incorrect or invalid wallet address supplied by the Buyer.

    • Any loss of the NFT due to Buyer negligence or wallet incompatibility.

  • The transfer will be initiated once the above conditions are satisfied. The Seller will provide a transaction ID or blockchain confirmation to verify delivery.

5. Digital Nature of the Item

  • The NFT being sold is a digital blockchain asset and does not include delivery of any physical item.

  • Upon transfer, the NFT exists solely on the blockchain and is accessible via the Buyer’s digital wallet.

  • The Buyer understands that blockchain transfers are irreversible and permanent once executed.

6. No Refunds or Cancellations

  • Due to the nature of blockchain transactions, all NFT sales are final.

  • Once the NFT transfer has been initiated or completed on the blockchain, no refunds, cancellations, or chargebacks are permitted.

  • By completing the purchase, the Buyer acknowledges the permanent and non-reversible character of the transaction.

7. Intellectual Property Rights

  • The purchase of this NFT grants the Buyer ownership of the token itself recorded on the blockchain.

  • Unless explicitly stated by the Seller, ownership of the NFT does not grant:

    • Copyright or intellectual property rights to the underlying artwork, media, or content linked to the NFT.

    • The right to reproduce, distribute, or modify the digital artwork or metadata associated with the NFT.

  • All copyrights and intellectual property rights remain with their respective owners.

8. Blockchain Network Risks

  • The Seller is not responsible for any issues resulting from blockchain network errors, delays, or disruptions (e.g., network congestion, high gas fees, or blockchain downtime).

  • In the case of network failures or events beyond the Seller’s control, NFT transfer may be delayed until normal operations resume.

  • The Buyer assumes all risks associated with blockchain technology, including loss of keys, wallet access, or transfer errors outside the Seller’s control.

9. Liability Disclaimer

  • The Seller makes no warranties, express or implied, regarding the functionality, value, or future performance of the NFT.

  • The Buyer acknowledges that NFT values are speculative and subject to market fluctuations.

  • The Seller shall not be liable for any loss of value, market changes, or inability to resell the NFT.

  • The Buyer is responsible for ensuring they understand how to manage and store digital assets securely.

10. Dispute Resolution

  • Any disputes arising from this transaction should first be communicated through eBay’s resolution process.

  • If unresolved, both parties agree to attempt amicable settlement before seeking legal remedies.

  • All disputes will be governed by applicable laws in the Seller’s jurisdiction.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed under the laws of the Seller’s country or state of residence. Any legal proceedings shall take place in a competent court located within that jurisdiction.

12. Acceptance of Terms

By completing your purchase and submitting feedback on eBay, you acknowledge that you have read, understood, and agreed to all of the above Terms and Conditions.
The NFT transfer will proceed only when the Buyer has fulfilled both the payment and feedback requirements as described.
